RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS

8. RATIFICATION OF REASSIGNMENT OF STUDENTS TO SCHOOLS
Description

Reassignment of students to schools within the county have been approved by the administration or recommended by the Student Reassignment Appeal Board, in accordance with policies of the School Board.  They are presented for formal ratification.

GENERAL ITEMS

9. ACCEPTANCE OF PROPERTY FROM SARASOTA COUNTY
Description
The property, as described in the attached Quit Claim Deed, was dedicated in 1996 by the School Board to Sarasota County as part of the original Hand Road right-of-way.  During the 2009 Lakeview Elementary project review, it was determined by County staff that this property is excess right-of-way leftover from the construction of Hand Road.  The Sarasota County Commissioners deeded the property back to the School Board on July 7, 2009. 

Recommendation

That the School Board accept the quit claim deed for the previously dedicated land as identified in the attached document.

AGREEMENTS/CONTRACTS

10. APPROVAL OF THE CONTRACT BETWEEN THE YMCA'S HOMELESS CHILDREN AND YOUTH PROGRAM AND THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA
Description
The Florida Department of Education has reapproved the Homeless Services Project retroactive from July 1, 2009 through June 30, 2010. The YMCA will provide case management, community coordination and an in-service package related to best practices for the education of homeless students.

Recommendation
That the School Board approve the contract between the YMCA's Homeless Children and Youth Program and the School Board of Sarasota County, Florida.

11. APPROVAL OF AGREEMENT FOR SERVICES BY INDEPENDENT CONTRACTOR BOYS AND GIRLS CLUB OF SARASOTA FOR THE 21ST CENTURY COMMUNITY LEARNING CENTER PROGRAM IN SOUTH COUNTY
Description
This agreement details the relationship and responsibilities shared by the School Board of Sarasota County and the Boys and Girls Club to provide enrichment, tutorial, and extra-curricular activities as outlined in the 21st CCLC grant for 09-10 SY.

Recommendation
That the School Board of Sarasota County approve the agreement with Boys and Girls Club for 21st CCLC, 2009-2010, as presented.

12. APPROVAL OF AGREEMENT FOR SERVICES BY INDEPENDENT CONTRACTOR RILEY CHASE APARTMENTS, IN NORTH PORT, FOR THE 21ST CENTURY COMMUNITY LEARNING CENTER PROGRAM IN SOUTH COUNTY
Description
This agreement details the relationship and responsibilities shared by the School Board of Sarasota County and Riley Chase apartments to provide enrichment, tutorial, and extra-curricular activities as outlined in the 21st CCLC grant for 09-10 SY.


Recommendation
That the School Board of Sarasota County approve the agreement with Riley Chase apartments for 21st CCLC 09-10, as presented.

13. AGREEMENT BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND COMMUNITY REHAB ASSOCIATES, INC. FOR OCCUPATIONAL THERAPY, PHYSICAL THERAPY AND SPEECH THERAPY SERVICES FOR THE 2009-10 SCHOOL YEAR
Description
Occupational therapy, physical therapy and speech therapy are related services required by both Federal and State law for students with disabilities. Contracts with agencies, such as Community Rehab Associates, assist the district in providing these necessary services when direct hire staff is not available.

Recommendation
That the agreement between the School Board of Sarasota County, Florida, and Community Rehab Associates, Inc. be approved as presented.

FIELD TRIPS

14. APPROVAL OF THE SARASOTA HIGH SCHOOL THEATRE FIELD TRIP TO NEW YORK CITY, NEW YORK, ON FEBRUARY 12, 2010 THROUGH FEBRUARY 16, 2010
Description
Students of the performing arts will be given the opportunity to see the center of the performing arts industry in New York City. They will participate in instructional classes taught by professional performing in New York City. They will also get a chance to go to Broadway musicals, see a ballet and take tours of some of the most famous theatre houses in the world.

Recommendation
That the Sarasota High School Theatre field trip to New York City, New York, on February 12, 2010 through February 16, 2010, be approved.

EXPULSIONS

15. APPROVAL OF EXPULSION CASE NO. 09-439
Description
The student listed in Expulsion Case No. 09-439, is in violation of an accepted Expulsion Settlement Agreement for an alternative school placement.  On May 19, 2009, the student listed in Expulsion Case No. 09-439, violated School Board Policy 5.34(1)(g), Repetitive Disobedience/Insubordination.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 4 of the 2009-2010 academic year.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-439, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until June 4 of the 2009-2010 academic year.

16. APPROVAL OF EXPULSION CASE NO. 09-414
Description

The student listed in Expulsion Case No. 09-414, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On April 27, 2009, the student listed in Expulsion Case No. 09-414, violated School Board Policy 5.34 (1)(g), Repetitive Disobedience Insubordination.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until June 30 of the 2009-2010 academic year.



Recommendation

That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-414, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until June 30 of the 2009-2010 academic year.

Description

School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student will attend GED classes.

Description

19. APPROVAL OF STUDENT EXPULSION ABEYANCE CASE NO. 09-308
Description

School Board Policy 5.34(4), permits the Board to hold in abeyance the expulsion of a student if the student participates in a recognized alternative-to-expulsion program.  This student is being placed in an alternative school.



Recommendation
That Expulsion Case No. 09-308 be held in abeyance per School Board Policy 5.34.

20. APPROVAL OF EXPULSION CASE NO. 09-453
Description

The student listed in Expulsion Case No. 09-453, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On May 29, 2009, the student listed in Expulsion Case No. 09-453, violated School Board Policy 5.34(1)(d), Animal Cruelty.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County School until June 30 of the 2009-2010 academic year.



Recommendation
That in accordance with provisions of Sections 1006.07 (1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 09-453, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately until June 30 of the 2009-2010 academic year.

MATERIALS MANAGEMENT

21. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable.  Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.   

Recommendation
That the classification of equipment and furniture, as property to be deleted, be approved.

CONSTRUCTION

22. APPROVAL OF A NON-EXCLUSIVE UTILITY EASEMENT AT BAY HAVEN SCHOOL OF BASICS PLUS BETWEEN THE SCHOOL BOARD OF SARASOTA COUNTY, FLORIDA, AND THE CITY OF SARASOTA, FLORIDA
Description
This easement is for the storm water drainage system on the school property from Tamiami Circle West to Bon Air Avenue.  This storm system is maintained by the City as part of the overall storm drainage for the neighborhood.  This easement has been approved by the School Board attorney.

Recommendation
That the Non-Exclusive Utility Easement at Bay Haven School of Basics Plus between he School Board of Sarasota County, Florida, and the City of Sarasota, Florida, be approved as presented.

23. RATIFICATION OF AMENDMENT #1 TO THE ARCHITECT'S AGREEMENT FOR THE LAKEVIEW ELEMENTARY SCHOOL - ADMINISTRATION/CAFETORIUM/WING 100 PROJECT
Description

This amendment shall cover design and construction administration services for a Renovation of Wing 100 in lieu of a new Administration/Classroom building and complete remodel of Wing 100.  The project budget has been reduced from $12,425,000.00 to $1,500,000.00.  This amendment results in a net reduction of $370,541.25 to the agreed fees for design and construction administration services.



Recommendation
That Amendment #1 to the architect's agreement, dated 12/9/2008 (Item #32), with Fawley Bryant Architects, Inc. for the Lakeview Elementary School - Administration/Cafetorium/Wing 100 project be ratified as presented.

24. RATIFICATION OF AMENDMENT #1 TO THE CONSTRUCTION MANAGER'S PRECONSTRUCTION CONTRACT FOR THE LAKEVIEW ELEMENTARY SCHOOL - ADMINISTRATION/CAFETORIUM/WING 100 PROJECT
Description
This amendment shall reflect a change in the project from a new Administration/Cafetorium building and a complete remodel of Wing 100 to a Renovation of Wing 100.  The project budget has been reduced from $12,425,000.00 to $1,500,000.00.  This amendment results in a net increase of $6,000.00 to the agreed fees for preconstruction services.

Recommendation
That Amendment #1 to the Construction Manager's Preconstruction Contract, dated 1/6/2009 (Item #30), with Tandem Construction for the Lakeview Elementary School - Administration/Cafetorium/Wing 100 project be ratified as presented.

25. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) have been summarized on the enclosure for ease of review.  These change order(s) collectively total an increase of $56,463.00 in contract amounts.

FINANCE

26. APPROVAL OF FLORIDA EDUCATION FINANCE PROGRAM (FEFP) FULL-TIME EQUIVALENT (FTE) STUDENTS RESTORATION OF AUDIT ADJUSTMENTS FOR THE FISCAL YEAR ENDED JUNE 30, 2003
Description
The original audit disallowed 323.11 weighted FTE.  This adjustment restores 54.33 weighted FTE.  The final dollar allocation will be taken from this year's funds.  An allocation of $952,891 has been set aside in the 2009-2010 budget.

Recommendation
That the Florida Education Finance Program Full-Time Equivalent Students Restoration of Audit Adjustments for fiscal year ended June 30, 2003, be approved as presented.

27. APPROVAL OF ANNUAL FINANCIAL REPORT FOR FISCAL YEAR 2008-2009
Description
Chapter 6A-q.0071 (2) of the State Board of Education Administrative Rules requires that the Annual Financial Report be submitted to the Florida Commissioner of Education no later than the 11th of September each year.  Due to the complexity of the report, it will not be available for distribution until September 1.

Recommendation
That the Annual Financial Report for fiscal year 2008-2009 be approved as presented.
